"...father produced a photograph of the child (appendix 3) from the tutoring. When asked by the court whether this showed a happy looking child, he was unable to say it did but the child looked proud. Not knowing the child, I am not able to comment other than to say quite clearly the child is unsmiling, appears solemn and shows neither visible pride nor happiness as was first asserted. I find father demonstrates a lack of insight into his proscriptive encouragement of the young child to attend and to complete the homework. I am satisfied, both on the father's acknowledgement that did so and find evidence of the 17-year-old non-subject child is corroborative, that the father would remove the young child's toys to ensure the homework was done. I find this to be in the context of a young, distressed child. Notwithstanding the importance that father places on education, his emphasis was wrongly placed, he lacked insight and his proscriptive and directive treatment of the child amounts to emotional abuse."
